By accessing or using cash.land (the “Site”) and our related forms, services, and communications (collectively, the “Services”), you agree to these Terms of Use (the “Terms”). If you do not agree, do not use the Services.
2. Who We Are
Cash.Land (“we,” “us,” or “our”) is a direct real estate buyer that purchases vacant land nationwide for cash. We are not a brokerage and do not represent sellers in a fiduciary capacity.
3. Not Legal, Tax, or Financial Advice
Information on the Site is for general informational purposes only and is not legal, tax, or financial advice. You should consult your own advisors for guidance specific to your situation.
4. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services.
5. Your Submissions
When you submit property details or contact information, you represent that the information is accurate and that you have authority to share it. You grant us a non-exclusive license to use the information solely to evaluate and complete a potential land sale and to operate and improve the Services.
6. Accuracy; No Obligation to Purchase
We strive for accuracy but do not guarantee that any content, offer, or valuation is error-free. Submitting your land information does not obligate you to sell—nor us to buy—any property. All transactions are subject to due diligence, clear title, and a mutually executed agreement.
7. Communications & Consent (Calls/Text/Email)
By providing your phone number or email, you consent to receive communications related to your inquiry, including calls, texts (SMS/MMS), and emails. Message and data rates may apply. Text STOP to end messages and HELP for assistance. We may use automated systems where permitted; your consent is not a condition of any transaction.
8. Closings & Third-Party Partners
We may share limited details with trusted title or attorney partners solely to facilitate a closing you initiate. Those partners maintain their own policies and compliance. Closing timelines vary by state and title requirements.
9. Prohibited Uses
- Interfering with the Site’s operation, security, or availability;
- Reverse engineering, scraping, or using automated means without permission;
- Submitting unlawful, fraudulent, infringing, or misleading content;
- Impersonating another person or misrepresenting your affiliation.
10. Intellectual Property
The Site, including text, graphics, logos, and code, is owned by Cash.Land and protected by intellectual-property laws. You may not reproduce, modify, or create derivative works without our written consent.
11. No Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASH.LAND SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
13. Indemnification
You agree to indemnify and hold Cash.Land and our partners harmless from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.
14. Third-Party Links
The Site may link to third-party websites. We are not responsible for their content or practices. Accessing third-party sites is at your own risk.
15. Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Michigan, without regard to conflicts of laws principles. Any dispute will be resolved through binding arbitration on an individual basis in or near Berrien County, Michigan, under the rules of a recognized arbitration provider. YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration within 30 days of first using the Services by emailing [email protected] with the subject line “Arbitration Opt-Out.”
16. Changes to the Services or Terms
We may modify or discontinue any part of the Services at any time. We may update these Terms periodically; the latest version will be posted on this page with a revised effective date. Continued use signifies acceptance.
